La Unión Europea se enfrenta a uno de los retos más determinantes de su historia, dotarse de una Constitución. En este orden de cosas, y entre los avatares políticos en los que discurre su negociación, cobrará vital importancia la Carta de Derechos Fundamentales de la Unión, debido a su eventual papel en el seno de la misma como declaración de derechos autónoma y vinculante. Sólo analizando en perspectiva histórica el interés comunitario por este tipo de derechos, y examinando después su naturaleza jurídica, así como su contenido sustantivo, podremos concluir con la afirmación de la fuerza vinculante de la Carta, a pesar de su mera proclamación solemne en Niza.

The European Union faces one of the most decisive challenges in its history, endowing itself with a constitution. In this order of things, and among the political avatars in which negotiations take place, the Charter of Fundamental Rights of the Union will be of vital importance, due to its eventual role within it as an autonomous and binding declaration of rights. Only by analysing in historical perspective the community interest of this type of right and then examining its legal nature, as well as its substantive content, we can conclude with the affirmation of binding force of the Carter, despite its mere solemn proclamation in Nice.
