Las rentas de los deportistas en la fiscalidad internacional

Abstract

El objeto del presente artículo es el análisis de la tributación de los deportistas en la esfera internacional. Para ello, se realiza, en primer lugar, un estudio detallado y crítico de la normativa convencional española y del Modelo de Convenio de la OCDE, y, a continuación, el examen de la normativa interna. Todo ello acompañado de un análisis de la evolución de la doctrina jurisprudencial y administrativa existente. Con este fin son objeto de especial atención las modificaciones introducidas en los Comentarios al MCOCDE en la versión de 2014, que han venido a tratar de orientar con mayor precisión sobre el alcance del artículo 17 del citado Modelo, así como, los distintos regímenes especiales que en nuestro ordenamiento interno inciden en la tributación de las distintas rentas obtenidas por los deportistas.

The subject of this article is the analysis of the taxation of "sportsperson" in the international sphere. For it, there is realized, first, a detailed and critical study of the Spanish conventional regulations and the OECD Model Convention, and then the examination of the internal regulations. All this accompanied by an analysis of the evolution of the jurisprudential and administrative doctrine. To this end, special attention is given to the modifications introduced in the Comments to the MCOCDE in the 2014 version, which have sought to provide more precise guidance on the scope of Article 17 of the aforementioned Model, as well as the different special regimes in our internal order they affect the taxation of the different incomes obtained by the "sportsperson".
