Abstract

El artículo analiza los criterios que se usaban para determinar el tribunal con competencia para juzgar una controversia determinada, esto es, para fijar el fuero competente. En primer lugar, el artículo trata sobre la distribución de las causas judiciales entre la jurisdicción civil y la eclesiástica, y las soluciones contempladas para las causas mixtas. Además, tratándose de un estudio centrado en el derecho canónico, estudia la potestad de jurisdicción de la Iglesia en cuestiones de conciencia, la juridicidad del fuero interno y su uso en Hispanoamérica. A continuación, se analizan los criterios que usaba la Iglesia para fijar el foro competente: el domicilio, el contrato, el delito y la ubicación de la cosa. En el artículo se examina la aplicación de estos criterios en los contextos locales americanos (s. XVI a XVIII), comprobando cómo las soluciones traídas del derecho castellano y del derecho canónico configuraban allí la determinación del fuero competente. Por último, se analizan tanto los fueros privilegiados, como las formas extraordinarias para adquirir el fuero.
