En este trabajo señalamos cómo el Derecho avanza de una manera demasiado lenta si se compara con el desarrollo que está teniendo las tecnologías de la información y la comunicación (TIC) en el mundo actual y que afecta, entre otras muchas cosas, a las relaciones comerciales, pudiendo originarse –como consecuencia de este desarrollo jurídico tardío– numerosos problemas e incluso conflictos entre las personas que interactúan comercialmente en la Red. A la conclusión a la que llegamos es que, si bien es cierto que no existe una inseguridad jurídica entendida como tal en el ciberespacio, todavía nos queda un gran camino por recorrer, pues están apareciendo nuevos tipos jurídicos –y por lo tanto, nuevas consecuencias– que señalamos y que nuestra regulación en la actualidad no contempla de forma completa.
In this Project we have tried to show how the law advances too slow if we compare it with the development that technology (ICT) is having nowadays, and that affects, among other things, the commercial relationships, which can originate –as a consequence of this delayed legal development –many problems, even conflicts between the people who take part in the Network. We conclude that although it is true that there is no a lack of law in this area, we still have a long way to go, because are appearing new legal types –and therefore, new consequences– that our regulation currently does not contemplate completely.
