Abstract

Conforme a la fórmula de Radbruch, en caso de haber un conflicto entre la seguridad jurídica y la justicia, la seguridad jurídica merece, en general, la prioridad, salvo que la contradicción del derecho positivo con la justicia alcance una magnitud tan insoportable que la ley tenga que retroceder ante la justicia, como derecho incorrecto. Pero, especialmente para las leyes penales rige el principio “nulla poena sine lege”, según el cual la punibilidad de un hecho tiene que estar establecida legalmente antes de que el hecho sea cometido. Como consecuencia de este principio, al derecho penal positivo le corresponde una prioridad frente a la justicia, aun más estricta que la que rige para el resto del derecho positivo. Por ello, no solamente elementos del tipo penal extremadamente injustos, sino también causas de justificación extremadamente injustas siguen rigiendo, en principio, en respeto a la seguridad jurídica producida por ellos. En contra del punto de vista de Robert Alexy, R., incluso una ley penal positiva extremadamente injusta solo puede ser tratada como inválida, si por medio de ello no amenaza producirse una pérdida esencial en seguridad jurídica, porque la ley penal afectada, en virtud de que exista un acatamiento y aplicación deficitarias, de todos modos casi no sea observada socialmente y, por ello, no produzca ningún aporte fiable en seguridad para la orientación dentro de la comunidad estatal.
