Abstract

Este artículo se ocupa de la jurisprudencia de la Corte Interamericana de Derechos Humanos referida al derecho a la verdad que tiene la víctima individual y colectiva y su relación con el proceso penal, especialmente cuando se trata de crímenes de lesa humanidad. Se presenta someramente la evolución del derecho a la verdad en el ámbito interamericano y en los organismos internacionales y se analiza críticamente si estamos frente a un derecho de la víctima de conocer la verdad o frente a una obligación del Estado de investigar y sancionar. El trabajo se concentra en la relación entre el derecho de la víctima a la verdad y el crimen de desaparición forzada, y pretende responder a la pregunta de si el procedimiento penal es el mecanismo adecuado para esclarecer la verdad cuando se trata de la justicia de transición, cuyas exigencias de justicia, verdad y reparación tienen que ser satisfechas considerando aspectos jurídicos y políticos que permitan la mejor reacción a los crímenes contra los derechos humanos y no impidan la elaboración del pasado. This article deals with the case law of the Inter-American Court of Human Rights with respect to individual and collective victims’ right to the truth and its relation to criminal proceedings, particularly in the case of crimes against humanity. It briefly presents the evolution of the right to the truth in the Inter-American sphere and in international organizations and offers a discussion of whether this is in fact the victim’s right to know the truth or the State’s duty to investigate and punish. The work focuses on the relation between the victim’s right to the truth and the crime of forced disappearance, and attempts to establish if a criminal proceeding is the adequate mechanism for shedding light upon the truth in cases of transitional justice. Such processes involve providing justice, truth and reparations while considering the legal and political aspects for a response to crimes against humanity which does not preclude coming to terms with the past.
