Este documento presenta un breve recorrido por algunos supuestos con los que el legislador español opta por configurar la conducta típica, o alguno de sus elementos, sobre la base de algunas presunciones aún presentes en el Código penal, pese a que éstas resultan incompatibles con algunos principios del Derecho penal sustantivo y procesal.
This paper traces a short overview on several assumptions used by the Spanish legislator to define typical behaviors or one of their elements, based on some suppositions still present in the criminal code even though they are incompatible with some of the principles in substantial and procedural criminal law.
