Abstract

El siguiente trabajo no se limita a informar sobre el pensamiento jurídico-penal nacionalsocialista de los años 1933-1945 en Alemania, sino que pretende, además, mostrar que muchas de las concepciones desarrolladas entonces marcaron el Derecho Penal de posguerra hasta el presente. Esto vale tanto para la sustitución de los bienes jurídicos individuales por colectivos como para el complemento del dogma del bien jurídico mediante la idea de infracción de deber, la subjetivización de la concepción de lo injusto o la impregnación ética de funciones y contenidos del Derecho. Aun cuando el origen histórico-jurídico de una idea en el nacionalsocialismo no basta por sí mismo para su condena o rechazo, sí lleva a una sospecha inicial justi fi cada y da motivo a un examen crítico, un examen que para la dogmática jurídico- penal española, junto con la alemana, representa un especial desafío por su también pasado fascista. Der folgende Beitrag begnügt sich nicht damit, über das nationalsozialistische Strafrechts denken in Deutschland von 1933-45 zu informieren, sondern will darüber hinaus dartun, dass viele der damals entwickelten Vorstellungen auch das Strafrecht der Nachkriegszeit bis in die Gegenwart hinein geprägt haben. Dies gilt für die Ersetzung von Individual-durch Kollektivrechtsgüter ebenso wie für die Ergänzung des Rechtsgutsdogmas durch den P fl ichtverletzungsgedanken, die Subjektivierung des Unrechtsbegriffs sowie die Ethisierung von Funktionen und Inhalten des Rechts. Zwar reicht der rechtshistorische Ursprung einer Idee im Nationalsozialismus allein noch nicht aus, um sie zu verurteilen oder zu verwerfen, wohl aber führt er zu einem begründeten Anfangsverdacht gegen sie und gibt zu einer kritischen Prüfung Anlass –eine Prüfung, zu der neben der Strafrechtsdogmatik in Deutschland auch die in Spanien wegen dessen gleichfalls faschistischer Vergangenheit besonders herausgefordert ist.
