Abstract

El famoso caso de Judy Norman, resuelto por la Corte Suprema de Carolina del Norte en 1989, es el que mejor ilustra el problema de cómo tratar a las personas que matan en situaciones no confrontacionales (el caso más obvio es el de la mujer que padece el síntoma de la mujer maltratada que mata a su marido mientras duerme). La mayor parte de los comentaristas sostiene que aquel que mata a su maltratador mientras duerme, cuando no hay un ataque inminente, solo puede ser exculpado. Esto es, su conducta sería considerada antijurídica aunque a menudo no punible, por no haber podido actuar de otro modo. No estoy de acuerdo. Creo que aquel que mata a su maltratador en situaciones no confrontacionales no realiza un comportamiento antijurídico. Específicamente, considero que aquel que mata a su maltratador mientras duerme actúa en legítima defensa justificada si se dan dos condiciones: 1) el Estado no quiera o no pueda intervenir evitando nuevos ataques en el futuro inmediato, y 2) que la única alternativa posible consista en atacar al maltratador cuando no suponga una amenaza
