¿Es el Derecho penal internacional un «Derecho penal del enemigo»?

Abstract

Este artículo cuestiona la tesis del profesor alemán Günther JAKOBS según la cual en caso de necesidad, de grave peligro para la «seguridad cognitiva», lo que hay que hacer es recurrir a un Derecho penal especial, un «Feindstrafrecht» o «Derecho penal del enemigo», con el que el Estado no trata simplemente de castigar a los delincuentes, sino de luchar contra sus enemigos. El autor concluye que tanto en tiempos de Paz, como en tiempos de Guerra, no se necesita un Derecho penal del enemigo, ni tampoco un Derecho penal internacional del enemigo, para luchar eficazmente contra los que atacan las bases de la convivencia, bien sea a título individual, como delincuentes comunes, bien de forma masiva, con acciones terroristas; lo único que se necesita es el Imperio del derecho, tanto en el ámbito nacional, como en el internacional; pero de un Derecho que respete determinados principios y derechos fundamentales del ser humano, y que busque no la venganza, sino la Justicia, una Justicia igual para todos, para vencedores y para vencidos
