La diversidad cultural originada en procesos migratorios tiene gran importancia en la conformación de los sistemas penales europeos. Las penas se agravan cuando el delito se comete por motivos étnicos, raciales o religiosos. Y algunas costumbres foráneas, como la poligamia, no son aceptadas, manteniendo su carácter delictivo. Otro supuesto de multiculturalidad hace referencia al Derecho penal aplicable a los pueblos indígenas en América Latina.
