La importación como delito contra la propiedad industrial

Abstract

En este breve estudio se intenta realizar una aproximación a la importación como modalidad delictiva prevista en el art. 273.1 del Código Penal, es decir, a la importación de productos infractores de determinados derechos de propiedad industrial. De manera puntual, se trata de abordar las particularidades que presenta esta conducta derivadas de la especial naturaleza del objeto sobre el cual recae, así como de los diversos instrumentos jurídicos nacionales, comunitarios e internacionales que rigen los correspondientes derechos. Finalmente, se analiza la situación de las importaciones paralelas, a fin de determinar su inclusión en el marco del delito previsto en el indicado artículo del Código Penal español This short study is an attempt to carry out an approach to studying imports as a criminal form foreseen in article 273 of the Spanish penal code, that is, importation of products that violates certain rights of industrial property. More clearly, the particularities that present this conduct derived from the special nature of the object over which it rests are studied, as well as, the diverse national, community and international legal instruments that regulate the corresponding rights. Finally, the situation of parallel imports is analyzed in order to determine their inclusion in the framework of a crime foreseen in the indicated article of the Spanish criminal code
