Abstract

El siguiente trabajo no se limita a informar sobre el pensamiento jurídico-penal nacionalsocialista de los años 1933-45 en Alemania, sino que pretende además, mostrar que muchas de las concepciones desarrolladas entonces marcaron el Derecho penal de posguerra hasta el presente. Esto vale tanto para la sustitución de los bienes jurídicos individuales por colectivos como para el complemento del dogma del bien jurídico mediante la idea de infracción de deber, la subjetivización de la concepción de lo injusto o la impregnación ética de funciones y contenidos del Derecho. Aun cuando el origen histórico-jurídico de una idea en el nacionalsocialismo no basta por sí mismo para su condena o rechazo, sí que lleva a una sospecha inicial justificada y da motivo a un examen crítico un examen, que para la dogmática jurídico-penal española, junto con la alemana, representa un especial desafío por su también pasado fascista
