[EN] After drawing up the contraposition between the liberal doctrine and the democratic theory, which pervades all modern and contemporary political philosophy, this article examines the reasons that Habermas states for considering that the effective usufruct of human rights is strictly linked with the exercise of a democracy conceived as deliberative practice, so that the delineated contraposition could be resolved. The exposition advances in four steps: first, the theoretical features of the discoursive meaning of human rights are analysed; then, the content of the legal framework considered by Habermas is dissected; in a next step, the reasons for the mutual relation between the principle of popular sovereignty and human rights are identified; finally, the model of deliberative politics is presented as an adequate way to include both factors of legitimation simultaneuously.
