Preparando la vejez: mujer y capitulaciones matrimoniales en el mundo rural altoaragonés en la Edad Moderna

Abstract

En los últimos años de su vida, la mujer corría serio riesgo de sumirse en la pobreza. Escasas de fuerza, en muchos casos viudas, eras pocas las que disponían de una rentas más o menos regulares. La legislación aragonesa paliaba esta situación merced al reconocimiento del derecho al usufructo por parte del cónyuge supérstite de los bienes del fallecido que venían a sumarse a la dote que la mujer había aportado al matrimonio y a su ampliación por parte del marido. Sin embargo, en el Alto Aragón la mayoría de las capitulaciones matrimoniales incluyen la renuncia a la viudedad foral y, por tanto al usufructo. Con numerosas variantes, estos documentos dejan entrever un objetivo que nada tiene que ver con la mejora de la situación de las viudas, sino con la pervivencia de la casa, como valor máximo de aquella sociedad rural.
