Abstract

[ES]: Este trabajo tiene por objeto el análisis de la autonomía de la decisión del paciente en el ámbito sanitario público español cuando aquélla se encuentra condicionada por las creencias religiosas. A partir de la STC 154/2002, de 18 de julio, se realiza un estudio de la normativa que regula el principio de autonomía del paciente, lo que permite seguir reflexionando sobre el supuesto escogido. La actualidad de esta sentencia estriba en el hecho de que en ella el Tribunal abre el camino a una diversidad interpretativa en el orden de valores generalmente admitido -en este caso, la percepción sacralizada del derecho a la vida- y sienta un precedente para el reconocimiento, de facto, de creencias minoritarias.

[EN]: This paper’s object is the analysis of the patient’s autonomy to decide within the framework of the Spanish public health care system when such freedom is determined by religious beliefs. Starting from the July 18th STC 154/2002 a study of the rules that regulate the principle of the patient’s autonomy is carried out, enabling one to continue to reflect on the chosen case. The topicality of the sentence lies in the fact that in it the Court yields a wide range of interpretations regarding the generally accepted order of values –in this case, the consecrated perception of the right to life—and sets a precedent for the recognition, de facto, of minority beliefs.
