Abstract

[ES] Esta contribución gira en torno a los niños en las legislaciones islámicas, desde época medieval hasta la codificación de los estatutos personales en los países arabo-islámicos. Como en otros sistemas legales, los menores según la shari‘a tienen un estatuto jurídico específico que, por un lado, los cuida y protege, y por otro, establece límites y fronteras para su capacidad de actuar. A través de la presentación de casos concretos, se explican diferentes situaciones en las que se establece y regula esa protección de los menores a través de tutorías, custodias y manutenciones dentro de las familias, así como las instituciones que protegen a los huérfanos según el derecho. Igualmente, el estudio de algunos casos nos muestra algunas situaciones que hablan de los límites de esa infancia según la ley, a través de la búsqueda, en la jurisprudencia, del establecimiento de la mayoría de edad. Finalmente, se presenta a la infancia dentro de las familias, mostrando casos en los que vemos las relaciones entre los padres y sus hijos, los embarazos, las nodrizas, los establecimientos de periodos de lactancia, así como el matrimonio de menores y los matrimonios concertados, así como la opinión de los juristas respecto a estas prácticas.

[EN] This contribution revolves around children in Islamic legal systems from medieval times until the establishment of legal codes governing personal statuses in Arab and Islamic countries. As in other legal systems, according to the shari‘a minors hold a specific legal status which, on the one hand, ensures their care and protects them, while on the other hand setting limits and boundaries on their capacity to act. By presenting specific cases, different situations are explained in which the protection of minors is established and regulated through guardianship, custody and child care payments within families, as well as the institutions meant to protect orphans in accordance with the Law. Similarly, some case studies show us a series of situations which demonstrate the limits of childhood according to the law, by searching the jurisprudence for cases in which the age of majority was determined. Last of all, childhood within families is discussed through illustrative cases in which we see the relationships between parents and their children, pregnancies, wet nurses and breastfeeding periods, as well as the marriage of minors and arranged marriages, along with the opinion of legal scholars regarding such practices.
