Abstract

[EN] If such statutes are considered not from the positivist perspective that is predominant in historiographical tradition, but rather as an effect of an identical cultural fact, which consisted in making possible the general knowledge and enforcement of law by means of its fixation in written form, the Fueros, or special statutes, of the towns and districts of Las Encartaciones, together with those from the rest of the Seigniory and even those from the rest of the peninsular kingdoms do not exhibit any other differences than those that could be derived from spatial and temporal circumstances. The result of a critical analysis of the the Fueros that have reached us, together with the comparative study of those that have been offered to us because of their similarity, presents them all as the result of a compiling process that obliges us, at the very least, to doubt if not to resolve some of the data contained therein which have been received by historiography, whether it be the condition of fueros de francos of the Fuero of Logroño, or the identification of such special charters with the privileges associated with the condition of being a town, or the joint action of Corregidor Gonzalo Moro and the Council of Avellaneda, or the scope of scholar Juan Sáenz de Salcedo, and various others.

[ES] Contemplados no desde la perspectiva positivista dominante en la tradición historiográfica, sino como efecto de un mismo hecho cultural, el de hacer posible el conocimiento y aplicación del derecho mediante su escrituración, los fueros de las villas y concejos de las Encartaciones, como los del resto del Señorío e incluso de los otros reinos peninsulares no presentan otras particularidades que las que se puedan derivar de las circunstancias espacio-temporales. El resultado del análisis crítico de los instrumentos conservados, así como el estudio comparativo de los que se nos ofrecen como similares, muestran a todos ellos como fruto de un proceso compilador que obliga cuanto menos a poner en tela de juicio, cuando no a resolver, algunos de los datos que en ellos se contienen y han sido recibidos por la historiiografía, ya se trate de la condición de fuero de francosde la carta foral logroñesa, o de la identificación de las cartas forales con los privilegios de villazgo, o de la actuación conjunta del corregidor Gonzalo Moro y la Junta de Avellaneda, o del alcance de la labor del licenciado Juan Sáenz de Salcedo, y algunos más.
