La justicia y los “peritos indigenistas”: debates y prácticas en procesos judiciales a indígenas en el siglo XX

Abstract

En esta ponencia, nos proponemos analizar el papel de los indigenistas en los procesos judiciales a indígenas, considerando tanto su contribución al debate sobre la legislación tutelar, las leyes especiales, la inimputabilidad o la responsabilidad atenuada, sino también su participación como “peritos” o expertos en juicios concretos. De esta manera, quisiéramos averiguar cómo fueron aplicadas, interpretadas y reformuladas en los juicios las expresiones, generalmente vagas y ambiguas, que se referían a las “condiciones culturales” o a las “circunstancias especiales” de los indígenas, cuando había mención explícita en la legislación, o como se enfrentaron estos casos cuando no había legislación especial y se apelaba a circunstancias atenuantes. Por otra parte, proponemos una reflexión sobre la relación entre el debate indigenista de mediados del siglo XX (y el papel de los indigenistas en los juicios) y el debate posterior sobre el peritaje antropológico en el marco de los llamados “derechos indígenas”
