La realidad de los bienes habices en el ocaso de la Granada nazarí

Abstract

Este trabajo ofrece una sinopsis de la situación en la que se hallaba la institución de los bienes habices o legados piadosos islámicos en vísperas de la conquista cristiana de la Granada nazarí, tomando como base cinco preguntas jurídicas que intentaban hallar soluciones a los diferentes problemas y desafíos que amenazaban la pervivencia de este tipo de propiedades en el reino granadino. Estas cinco cuestiones formaban parte de las 25 consultas legales de temática muy variada que el muftí granadino del siglo XV al-Mawwaq envió a uno de los alfaquíes más eminentes por aquel entonces en el Norte de África, Muhammad al-Rassa`. A finales del siglo XV, todas esas preguntas junto con sus respuestas fueron recogidas en una obra que se conoce como Al-Aywiba al-tunisiyya `alà al-as’ila al-garnatiyya (‘Las respuestas [jurídicas] tunecinas a las preguntas granadinas’).
