Abstract

El presente ensayo es un análisis filosófico-jurídico de la célebre sentencia 38/2018 de 20 de marzo de la Audiencia Provincial de Navarra sobre el caso de «La manada». Céntrase mi análisis se centra en el distingo entre el juicio moral que nos merezcan los hechos incriminados y el juicio jurídico-penal. La personal valoración ética de quien suscribe condena moralmente los hechos por considerar moralmente ilícita la fornicación, con el agravante de que el comportamiento de los acusados implica una grosería y actuación egoísta, además de ausencia de caballerosidad. Pero, desde el punto de vista jurídico (y desde la única rama del Derecho concretamente aplicable, el Derecho penal), mi estudio concluye que es correcto el voto disidente recogido en la Sentencia porque lo único controvertido en el juicio había sido la violación (agresión sexual), la cual supone violencia o intimidación. Al no haberse probado ni violencia ni intimidación, sólo cabía la absolución. Es errónea, en cambio la sentencia mayoritaria porque, no es ya que dé a los hechos debatidos en el juicio una nueva y diversa calificación jurídica, sino que reemplaza los hechos discutidos en el juicio por otros de su cosecha, lo cual viola el principio de acusatoriedad y causa indefensión. Por otro lado argumento que se equivocan los dos magistrados mayoritarios en la calificación jurídica que dan de los hechos, adscribiendo gratuitamente a los acusados un dolo no demostrado (ni debatido) y un imposible conocimiento jurídico.

This is a critical assessment of a famous judicial ruling in Spain, approaching it from the fundamental difference between the moral and the legal point of view. The paper claims that legally the accused men should have been acquitted, even if their behaviour is morally wrong.
