The issue of intellectual property has become somehow entangled and blurred. As against such as cleave to a stringent and narrow copyright dispensation (admittedly not many academics aquiesce in such hardened attitude), a lot of people are nowadays enthusiastic about Open Access or even (at least a few of them) copyleft, with many people spurning even the idea of intellectual property altogether. This License is built upon my previous study into (and defense of) intellectual property, which I deem by far more legitimate than private ownership of material objects. Nevertheless the essence of intellectual proerty consists of authors' moral rights, a notion which is not recognized (at least not clearly and directly) in common-law jurisdictions -- although it is espoused by the Berne convention and other international treaties. My License (LICENCIA LAURENTINA) is Public Access, not open access. Notice that my papers made publicly available at this or any other site are covered by this license, wich trumps any contrary terms and conditions.

Este documento jurídico está basado en un estudio científico de la propiedad intelectual (previamente publicado en la revista ARBOR con el título "Propiedad intelectual privada frente a la investigación como servicio público"). Frente al nihilismo de la propiedad intelectual, la defiende, centrándola en los inalienables e irrenunciables derechos morales de autor, por lo cual el derecho de propiedad intelectual está basado en derechos fundamentalísimos del ser humano, en las libertades de pensamiento, opinión y creación.
