La justicia es un valor instrumental, conexo e indeterminado. Carece de sustantividad, siendo adyacente a valores sustanciales. Un trato justo es uno que se conforma con los dos cánones de proporcionalidad y relevancia. Hace falta averiguar, independientemente, cuál es la proporción idónea y cuáles son las cualidades relevantes (verbigracia, si la indemnización justa ha de ser proporcional al daño infligido o al lucro obtenido por quien lo ha causado). De suyo la noción de la justicia es sólo un recipiente formal y hueco, que ha de venir llenado por consideraciones atinentes al bien público. Siendo un medio y no un fin, la justicia tiene que armonizarse con otros valores que a menudo entran en conflicto con ella, como la concordia y la seguridad jurídica.
