Abstract

La comunidad internacional muestra su preocupación por la preservación y protección de las expresiones culturales tradicionales desde hace varias décadas. Especialmente la UNESCO y la Organización Mundial de la Propiedad Intelectual (OMPI), buscan vías para evitar la expoliación y, en general, promover la protección del folclore. Entre las medidas que se proponen, la OMPI considera que las leyes de propiedad intelectual son un recurso a tener en cuenta. Con el presente trabajo se trata de estudiar cuáles de las expresiones del folclore cumplen los requisitos que normalmente se exigen a las obras frente a las que no los reúnen, para analizar después el lugar que ocupan en las normas de propiedad intelectual, tanto si se trata de expresiones antiguas como de obras creadas por autores contemporáneos.

It is since some decades that the International Community has shown signs of a substantial concern towards the preservation and protection of traditional cultural expressions, specifically the UNESCO and the WIPO which are in quest of anti-exfoliation measures and folklore protection as well. Among the aforementioned measures the WIPO highlights Intellectual Property legislation as a highly useful tool. This article study the folkloric expressions qualifying as intellectual works in addition to their role within the Intellectual Property regulations, whether they are old works or contemporarily created.
