Las sanciones administrativas en relación con las prácticas de competencia desleal

Abstract

El presente trabajo persigue un triple objetivo: la exposición de las premisas básicas de las que deriva el régimen administrativo sancionador de las prácticas de competencia desleal, partiendo de un conciso análisis de la Directiva 2005/29/CE, sobre Prácticas Comerciales Desleales y su transposición al Derecho español; la determinación del régimen sancionador de dichas conductas y el estudio de los órganos a los que se atribuye el conocimiento de aquellas. La parte final de nuestro trabajo la dedicaremos al análisis comparativo entre las escasamente estudiadas sanciones de las prácticas de competencia desleal y los supuestos más genéricos de aquellas impuestas a las prácticas restrictivas de la competencia.

This study has a triple purpose: the exposition of the basic premises from which the administrative sanctioning procedure for unfair competition practices derives, in accordance with the provisions of Directive 2005/29/EC on Unfair Commercial Practices, as well as its transposition into Spanish law; the determination of the sanctioning regime for said practices and the study of the bodies to which knowledge of them is attributed. The final part of our work will be dedicated to the comparative analysis between the scarcely studied sanctions for unfair competition practices and the more generic cases of those imposed on restrictive competition practices.

El presente artículo se enmarca en el proyecto de investigación del Ministerio de Educación "La evolución del espacio judicial europeo en material civil y penal: su influencia en el proceso español"., financiado por la Agencia Estatal de Investigación, Investigadora Principal, Prof. Dra. Mar Jimeno Bulnes, Universidad de Burgos.
