El testimonio adjunto en Colombia, una aproximación crítica

Abstract

When a witness’s testimony during trial contradicts a previous statement — a situation known as recantation — it poses a significant challenge in legal systems where evidence is only considered valid if presented during a public hearing before a judge. In Colombia, the Supreme Court of Justice has developed a jurisprudential doctrine to address this issue, known as the “attached testimony” rule. This paper first analyzes the characteristics, evolution, and impact of this legal doctrine within the Colombian justice system. Subsequently, we evaluate the validity of this rule using hermeneutical and epistemic criteria. Our analysis suggests that the “attached testimony” does not effectively fulfill the purpose for which it was created, especially considering that existing procedural rules may offer more appropriate alternatives for addressing cases of recantation

La retractación de los testigos en juicio constituye un reto para los ordenamientos jurídicos donde prueba es únicamente los que se produce en curso de la vista pública y ante un Juez. En Colombia, la Corte Suprema de Justicia ha diseñado jurisprudencialmente una estrategia para enfrentar dicha problemática: el “testimonio adjunto”. En este escrito, en primer lugar, analizaremos las características, la evolución y el impacto que ha tenido el “testimonio adjunto” en nuestro sistema de justicia. Posteriormente, lo evaluaremos a partir de criterios hermenéuticos y epistémicos, lo que nos permitirá establecer que la figura está lejos de cumplir con la finalidad para la que fue creada, considerando que las normas procesales existentes ofrecen mejores alternativas para superar el problema de la retractación
