El orden debido en la determinación de la residencia fiscal: el papel de la interpretación autónoma y de los certificados fiscales

Abstract

La resolución de los conflictos de doble residencia fiscal debe abordarse siguiendo un orden debido. Los pasos parten del respeto al principio de jerarquía normativa: los tratados internacionales son de aplicación preferente si se aportan determinadas pruebas para deter-minar la residencia fiscal, como ocurre ante un certificado fiscal. Algunos órganos han estima-do que esta prueba es indiciaría lo cual conlleva valorarlo con el resto de las pruebas. La consecuencia de todo ello será interpretar un asunto convencional a través de circunstancias domésticas. Esta línea de algunos tribunales es errónea y, como veremos, así lo ha manifesta-do el Tribunal Supremo en una reciente sentencia
