La jurisprudencia del Tribunal Europeo de Derechos Humanos nos ofrece una importante doctrina sobre la libertad religiosa y también sobre la igualdad de género. En este trabajo, realizo un estudio sobre las principales sentencias con referencia especial al velo islámico, y otras cuestiones (el reconocimiento de matrimonios religiosos y la aplicación del derecho islámico). El análisis es desde la perspectiva de género. En algunos casos, veremos cómo el Tribunal Europeo no considera que exista discriminación; no obstante, sus resoluciones tienen consecuencias para el derecho de las mujeres
The jurisprudence of the European Court of Human Rights (ECHR) gives rise to an important body of doctrine on religious freedom and also on gender equality. This article is based on a study of the leading judgements, with special reference to Islam’s hijab, and other matters (recognition of religious marriages and the application of Sharia). This analysis is from the gender perspective. In some cases, we will see that the ECHR rules that there is no discrimination. Nevertheless, its judgements have consequences for women’s rights
