Abstract

El Código de Procedimiento Penal Colombiano, de naturaleza adversarial, limita el contrainterrogatorio de los testigos a los temas abordados en el interrogatorio directo, de acuerdo con la teoría del caso de cada una de las partes. Esta limitación, si bien resulta obvia en un sistema en el cual cada litigante debe defender los intereses que representa, desencadena ciertas inquietudes desde el punto de vista de la psicología del testimonio, en tanto que esta técnica podría contaminar la memoria de los testigos. Conceptos como el sesgo de confirmación, entre otros aspectos, sugieren que los testigos pueden ajustar inconscientemente sus recuerdos para alinearlos con la información presentada durante los interrogatorios. De manera que podrían explorarse estas vicisitudes desde la perspectiva de la fiabilidad de la prueba testimonial, el fin institucional del proceso de acercarse a la verdad y del derecho a la contradicción de la prueba

The Colombian Code of Criminal Procedure, with adversarial tendency, limit the cross examination of witnesses to the topics addressed in direct examination, according to the theory case of each litigant. This limitation, although obvious in a system in which each party must defend the interests it represents, triggers certain concerns from the point of view of the psychology of testimony, since this technique could contaminate the memory of witnesses. Concepts like confirmation bias, among others, suggest that witnesses may unconsciously adjust their recollection to align with the information presented during interrogatories. Thus, the vicissitudes could be explored from the perspective of the reliability of testimonial evidence, the institutional purpose of the process of geIng closer to the truth and the right to contradict evidence
