Simplificación administrativa y Directiva de servicios: objetivos, medios e incidencias

Abstract

This article describes the means of administrative simplification that the Services Directive imposes, in the framework of the European policies and strategies of better regulation, and how they have been incorporated into basic legislation in Spain. There is also an analysis of the simplification that reduction of administrative burdens brings. In this scenario, the regulatory impact assessment seems to be an ideal instrument to guarantee that the administrative simplification does not have negative effects on the sphere of rights and guarantees of third parties. Finally, it puts the accent on the necessary counterweights to administrative simplification

Este artículo describe los medios de simplificación administrativa que impone la Directiva de Servicios, en el marco de las políticas y estrategias europeas de mejora regulatoria, y cómo han sido incorporados a la legislación básica. Se analiza también la simplificación que conlleva la reducción de cargas administrativas. En este escenario, la evaluación del impacto normativo parece ser un instrumento idóneo para garantizar que la simplificación administrativa no incide negativamente en la esfera de derechos y garantías de terceros. Por último, se pone el acento en los contrapesos necesarios de la simplificación administrativa
