Racionalidad y juez legal acerca de la relevancia de los estándares de prueba en los juicios de competencia penal

Abstract

El artículo, mediante el uso del aparato conceptual de la obra de Jordi Ferrer Beltrán, analiza una serie de sentencias y normas jurídicas del derecho argentino que versan sobre contiendas de competencia entre tribunales penales. En rigor, los problemas de competencia jurisdiccional se pueden estudiar como problemas jurídicos de subsunción ––quaestio juris––; sin embargo, ese es un modo limitado de abordaje, dado que las cuestiones de competencia tienen también un lado fáctico ––quaestio facti–– en sus presupuestos que debe ser probado en el proceso. De allí, entonces, la propuesta que formula el autor de contar con estándares de prueba que fijen las condiciones de aceptabilidad de las proposiciones como descripción de los hechos del caso. En definitiva, el abordaje racional de los juicios de competencia penal que se propone contribuye a que las decisiones de los tribunales se asienten sobre parámetros establecidos, que brinden previsibilidad y seguridad a los individuos que recurren al servicio de administración de justicia, poniendo en valor, a su vez, el contenido de la garantía del juez legal
