Abstract

El fenómeno de la violencia de género abarca una multitud de comportamientos, algunos de ellos aún invisibilizados en la actualidad, es el caso de los suicidios de mujeres provocados por los malos tratos recibidos por sus parejas y/o exparejas. Constatando la correlación entre suicidio y violencia de género, este trabajo pretende estudiar las vías de imputación de responsabilidad penal con el objetivo de que dichos suicidios no queden impunes. Estamos hablando del estudio de la parte general del derecho penal, esto es, la imputación objetiva del homicidio, así como del análisis del tipo específico de la inducción al suicidio. Finalmente, para adoptar la respuesta penal más adecuada, se estudia la agravante por género, así como el tipo penal concreto del derecho penal salvadoreño conocido como suicido feminicida que castiga concretamente la situación objeto de estudio

The gender violence phenomenon includes all kind of behaviours, some of which are not yet detected at this time. This is the case of suicides committed by women and caused by abuse from their partner or ex-partner. Demonstrating the correlation between suicides and gender violence, this investigation aims to research the ways penal responsibility is attributed in order that these suicides do not go unpunished. The area studied, the objective imputation of homicide, and analysis of the specific offence of inducing suicide, is within the area of general penal law. Finally, to adopt the most suitable penal response, I will study the circumstances, based on gender, that modify the penal responsibility as well as the specific type of crime regulated in the Salvadoran penal law known as femicide suicide which specifically punishes the situation studied in this project
