Abstract

Más allá de la amplia y cuidadosa labor "conservadora" que, suplendi gratia, ha realizado la jurisprudencia respecto de las diversas funciones que pueden desempeñar las arras, persiste, en mi opinión, un significado asistemático e incoherente entre los varios que se le reconocen hoy a la institución. Paradójicamente, me refiero al único sentido que sí es recordado por el artículo 1454 del Código civil, el de "arras penitenciales", el cual, seguramente por el mismo hecho de no haber requerido reconstrucción, no parece haber estimulado suficientemente la mirada crítica de los juzgadores. Actualmente se consideran arras penitenciales aquéllas que se dan durante la celebración de un contrato, atribuyéndole a las partes la posibilidad de poenitentia, es decir, de arrepentimiento, respecto de aquel contrato ya perfecto en cuya celebración han mediado; la parte que desiste debe soportar la pérdida del arra o, en su caso, la restitución de la recibida más el pago de alterum tantum -se ha señalado lo incorrecto de la expresión "devolverlas duplicadas"-; en síntesis, se pacta la facultad bilateral de desistimiento del contrato bajo sanción arral para quien la ejerza. A pesar de la actual dualidad de fuentes jurídicas que informan la institución de las arras (jurisprudencia y ley), el que las penitenciales provengan de un mismo tronco histórico que el resto de los regímenes elaborados por la praxis de los tribunales permite conectar sus diferentes sentidos para volver sobre el viejo debate respecto de la función que debe corresponder a las arras penitenciales frente al contrato
