Abstract

Se analiza el problema de la prueba de la discriminación, en especial del tipo de discriminación llamada indirecta, que atiende a los efectos que provocan las normas, políticas o prácticas que, pese a ser neutrales en su enunciación, perjudican especialmente a ciertos grupos vulnerables en comparación con otros. El análisis adopta la perspectiva del razonamiento probatorio. Indaga, por un lado, sobre las estrategias de distribución del riesgo probatorio implementadas en los casos de discriminación indirecta. Y se pregunta, por otro lado, sobre la función epistémica que puede cumplir el conocimiento estadístico para tener por probada una hipótesis de discriminación indirecta. Al respecto, hace aportes para identificar el campo de acción de la estadística aplicada a dicha clase de casos, así como algunos conceptos y herramientas básicas del conocimiento estadístico que permiten lograr resultados válidos y significativos sobre los hechos relevantes

The problem of proof of discrimination is analyzed, especially in the type of discrimination called indirect, which attends to the effects caused by rules, policies or practices that, despite being neutral in their enunciation, have a worse effect on some people than others. The analysis takes the perspective of evidential reasoning. It investigates, on the one hand, the probative risk distribution strategies mplemented in cases of indirect discrimination. And it inquires, on the other hand, about the epistemic function that statistical knowledge can fulfill in order to have a hypothesis of indirect discrimination as proven. In this regard, it makes contributions to identify the field of action of statistics applied to this class of cases, as well as some basic concepts and tools of statistical knowledge that allow obtaining valid and significant results on relevant fact
