Abstract

El presente trabajo constituye una aproximación que se propone analizar un conjunto de relaciones existentes entre dos conceptos de especial relevancia: el de sesgo cognitivo y el de la valoración individual de la prueba. Para tal fin se efectúa una breve reconstrucción de sus aspectos centrales y a partir de allí se muestra como a pesar de las distintas situaciones posibles que se presentan en esta fase del proceso judicial, la presencia de los sesgos concretamente desafía más de las veces el cumplimiento de sus diversos objetivos. Finalmente, si bien las conclusiones a las que se arriba son diversas, particularmente otorgan buenas razones para en adelante emprender la búsqueda de alternativas de solución en mejora de las diversas decisiones que se toman en cualquier proceso judicial

The present work constitutes an approach that aims to analyze a set of existing relationships between two concepts of special relevance: that of cognitive bias and that of the individual evaluation of the evidence. For this purpose, a brief reconstruction of its central aspects is carried out and from there it is shown that despite the different possible situations that arise in this phase of the judicial process, the presence of biases specifically challenges compliance with its various objectives. Finally, although the conclusions reached are diverse, they particularly provide good reasons to henceforth undertake the search for alternative solutions to improve the various decisions taken in any judicial process
