Este trabajo busca exponer las posturas que se han adoptado para el establecimiento del estándar de prueba en materia administrativa sancionadora, las cuales han partido de las relaciones que existen, autonomía o dependencia total o parcial “con matices”, entre el derecho penal y el administrativo sancionador, y con ello, reflexionar si por compartir los principios jurídico penales corresponde aplicar a esta materia el estándar de prueba que se utiliza en materia penal, o si por el contrario, el análisis debe realizarse en función de la severidad de las consecuencias jurídicas de las sanciones, ya que a mayor gravedad de las consecuencias jurídicas, más peligro existe de que el daño producido por las sanciones supere el beneficio derivado de ellas, y por tanto, más garantías se requieren para evitarlo. De esto último se concluye que el principio de presunción de inocencia no se ve mermado por el hecho de que la configuración del debido proceso tenga un tratamiento diferenciado en función de la gravedad de las consecuencias jurídicas, y por establecer un umbral de suficiencia probatoria que difiera del penal
This paper seeks to expose the positions that have been adopted for the establishment of the standard of evidence in administrative sanctioning matters, which have started from the relationships that exist, autonomy or total or partial dependence “with nuances”, between criminal and administrative law sanctioner, and thus, reflect on whether to share criminal legal principles corresponds to apply to this matter the standard of evidence used in criminal matters, or if on the contrary, the analysis should be carried out based on the severity of the legal consequences of sanctions, since the more serious the legal consequences, the greater the danger that the damage caused by the sanctions exceeds the benefit derived from them, and therefore, the more guarantees are required to avoid it.
