This paper establish the differences between the criminal process and the excecution of sentence about the evidentiary treatment, from an adversarial system, focusing on a reunderstanding the presumption of innocence based on the special conditions of persons who are deprived of liberty at the execution process. This will lead us to define issues such as the distinction between proof and evidence, establish criteria of burden of proof and evidentiary sufficiency, analyzed from the rational assessment of evidence
Este trabajo establece las diferencias en el tratamiento probatorio entre el proceso penal y la ejecución desde un modelo acusatorio y adversarial, enfatizando un reentendimiento de la presunción de inocencia a la luz de las especiales condiciones de las personas privadas de la libertad en la ejecución penal. Ello nos llevara a definir cuestiones como la distinción entre dato, medio y prueba, establecer criterios de carga de prueba y suficiencia probatoria, analizadas desde la valoración racional de la prueba
