Abstract

Cuando hablamos de la responsabilidad objetiva nos referimos al régimen de la responsabilidad que está libre de cualquier noción de culpa. Por tanto, en todos estos casos en los que la actividad desarrollada por el actor está sujeta a la responsabilidad sin culpa, este sujeto será responsable del daño resultante de dicha actividad, incluso si no fuera culpable, es decir, independientemente del grado de diligencia ejercida. Una vez el resto de los elementos exigidos para establecer su responsabilidad ha sido demostrado por la víctima, el demandado puede sustraerse a ésta solamente probando una de las causas de exoneración previstas por la Ley, si es que la hay. De ahí que la denominación genérica de responsabilidad objetiva, ligada por la ley a varios supuestos, no sea homogénea. No existe un único contra principio opuesto a la responsabilidad por culpa, como muchos pensaban inicialmente, sino varias formas del mismo género extendidas a lo largo de una línea y agrupadas dentro de una categoría debido a la común característica que poseen: la falta de necesidad de probar la culpa. El esquema se puede explicar utilizando la siguiente regla de dependencia: mientras menos causas de exoneración estén permitidas por la ley, más estricta será la responsabilidad, llegando en casos extremos a configurarse como una responsabilidad absoluta. Por otra parte, la extensión de las causas de exoneración depende del riesgo inherente a la actividad en cuestión. Si de la fuente de peligro dimanan riesgos de extrema magnitud, como en el caso de la explotación de energía nuclear, el legislador deja al causante del daño sin casi ninguna posibilidad de exoneración.

When we speak about strict liability we refer to the regime of liability that is free of any notion of fault. Therefore, in all those cases where the activity developed by the actor is subject to strict liability he will be held liable for the harm resulting from it even though he was not at fault or, in other words, independently of the degree of care exercised. Once the rest of the elements required in order to establish responsibility has been demonstrated by the victim, the tortfeasor can only escape with the liability proving one of the defenses foreseen by the law, if any . Thus, the generic denomination of strict liability, attached by law to several cases, is not homogenous. There is no one counter principle opposed to responsibility based on fault, as many thought at the beginning, but many forms of the same gender spread along a line and gathered within one category due to one common characteristic they pose- lack of necessity of proving fault. We can explain the schema using the following dependence rule: the fewer defenses allowed by law, the stricter the responsibility is, reaching in extreme cases absolute liability. On the other hand, the extent to which the defenses are allowed dependa on the risk inherent to the activity in question. If a source of danger brings about extremely high risks, as in case of exploitation of nuclear energy, the legislator excludes almost all of the defenses.
