Los diferentes medios de comunicación nacionales e internacionales se han hecho eco de los diversos procedimientos llevados a cabo contra Baltasar Garzón, Magistrado Juez de instrucción de la Audiencia Nacional. En particular, la condena por el Tribunal Supremo por un delito de prevaricación ha sido objeto de duras críticas desde determinados círculos que consideran al juez como un baluarte de la defensa universal de los derechos humanos frente a las violaciones de éstos, especialmente a raíz de la solicitud de extradición a España del general Pinochet. Una imagen menos positiva viene desde otros sectores que muestran a un “juez estrella” haciendo prevalecer sus intereses personales y/o políticos frente a principios fundamentales del Derecho. Ahora bien, lo más inquietante es que estos posicionamientos dispares se originan, en muchos casos, desde el desconocimiento de los argumentos jurídicos que han fundamentado la citada condena, basándose en las elucubraciones sensacionalistas libradas tanto desde la prensa internacional como la española. En nuestro país, viene siendo habitual que el llamado “periodismo de investigación” adelante, a partir de filtraciones de documentos oficiales y sumarios bajo secreto, informaciones que las leyes ordenan mantener reservadas para respetar las garantías a las que tiene derecho cualquier ciudadano sometido a investigación. Por consiguiente, lo que pretendo sencillamente es exponer serenamente los motivos jurídicos que fundamentaron la sentencia condenatoria, así como aquellos otros que, en relación a los otros dos procedimientos que contra el juez se han dirigido, dieron lugar a la absolución en el segundo, y al archivo del último.

The different national and international mass media have covered the distinct procedures that have been undertaken against Baltazar Garzón, Examining Magistrate Judge in the National High Court of Spain. More particularly, the sentence by the Supreme Court for having committed judicial misconduct has received harsh criticism from certain spheres that consider the judge to be a bastion of the universal defence of human rights against breaches of them, especially following the application for General Pinochet's extradition to Spain. A less positive image comes from other sectors that portray him as a "star judge" who allows his own personal and/or political interests to prevail over the fundamental principles of Law. Now, the most disturbing thing is that in many cases these disparate standpoints are deeply rooted in an utter ignorance of the legal arguments underlying the above-mentioned sentence, and are often based on the sensationalist imaginings published in both the international and the Spanish press. In our country, it is quite usual for the so-called “investigative journalism” to reveal information (gained from leaked official documents and investigations that have a gagging order on them) that the law states should be kept secret in order to respect the guarantees to which any citizen under investigation has a right to. Hence, my aim is to simply outline the legal motives that underlay the conviction, as well as the others that, in relation to the other two proceedings filed against the judge, gave rise to his acquittal in the second and the case being closed in the third.
