El presente artículo pretende contribuir al debate constitucional que actualmente está produciendo en la doctrina europea y estadounidense a propósito de la formalización constitucional en la Unión Europea. Comenzamos nuestro estudio desde la dualidad de derecho originario europeo: por un lado, actuando de facto como una norma suprema, como una constitución; por otro, siendo creado desde la lógica del Derecho Internacional Público. Esta dualidad supone un serio daño al principio de supremacía del Derecho Comunitario, así como al principio de soberanía popular, lo cual, a nuestro entender, demanda un cambio en la lógica del poder constituyente europeo. En segundo lugar analizamos la lógica diplomática que actualmente se aplica, centrándonos en las negativas consecuencias que tuvo en el tratado de Niza. Por último, concluimos clamando la necesidad de sacar partido de la Conferencia Intergubernamental de 2004 por mor de crear un poder constituyente que se corresponda con las necesidades constitucionales europeas.
The presented paper aims to contribute to the current constitutional debate within the European and American scholarly. Our starting point stands in the duality existed within the European Primary Law. On the one hand acting in practice as a supreme norm, a constitution itself; and on the other hand being created as an ordinary treaty under the Public International Law rules. This duality present a serious damage to the principle of Supremacy of EC Law upon National Constitutions, as well as to the principle of people sovereignty, which, in our view, calls for a change in the Constitutional power logic. Secondly we analyse the current diplomatic logic, focusing in the negative externalities produced in the Nice treaty. Lastly we conclude claming the need to take advantage of the 2004 Intergovernmental Conference in order to create a European constitutional power in balance with the European constitutional needs
