This study conducts a brief analysis, based on the scientific foundations of some European and, more particularly, Spanish regulations, of the thorny subject concerning the privileges enjoyed by high-ranking officials, authorities and civil servants in relation to criminal proceedings. More specifically, we seek to determine the extent to which such special protection may affect the principle of equality and, going a step further, whether such an exception must be justified and protected by a democratic constitution. En esta contribución se analiza brevemente, a la luz de las bases científicas de algunas regulaciones europeasy, en particular, de la española, el espinoso tema de los privilegios de altos cargos, autoridades y funcionarios públicos en el ámbito del proceso penal, más en concreto se busca precisar hasta que punto dicha protección especial puede afectar al principio de igualdad y, yendo más allá, si tal excepción al mismo debe estar justificada y protegida por una constitución democrática.
