Frente a las figuras de la separación judicial o el divorcio, que implican la disolución del matrimonio ante la petición de uno o ambos cónyuges, independientemente de los motivos que pudieran haberles llevado a ello, la nulidad matrimonial, ya sea civil o canónica, supone la ineficacia del matrimonio desde su origen, por lo que se entenderá que dicho matrimonio no ha existido nunca válidamente. Pese a que la sociedad suele identificar la nulidad matrimonial con la obtenida en sede canónica, el Código Civil también regula esta figura, resultando procedente conocer las características, requisitos y efectos de ambas figuras.
