Presunción de inocencia y decomiso

Abstract

El objeto de este artículo es analizar cómo se debe probar que los bienes tienen un origen ilícito y, así, poder acordar el decomiso ampliado, tras la transposición de la Directiva 2014/42/. UE del Parlamento Europeo y del Consejo de 3 de abril de 2014, sobre el embargo y el decomiso de los instrumentos y del producto del delito en la Unión Europea, que modificó la regulación del decomiso en el Código Penal, y su incidencia en el derecho del acusado a la presunción de inocencia. Y, por otro lado, el distinto tratamiento que recibe la prueba del origen ilícito de los bienes adquiridos por terceros, al ser el decomiso a éstos, un pronunciamiento civil.
