Abstract

Este trabajo es un análisis de la evolución del derecho de las personas a solicitar y recibir ayuda para morir en España. La primera fase se inicia con la publicación del Código Penal de 1995 donde, a pesar de que continúa prohibiéndose esta práctica, ya se abre un pequeño resquicio al atenuarse la responsabilidad de los cooperadores necesarios al suicido. En la fase intermedia, el legislador español se va acercando al reconocimiento de la eutanasia a través de las denominadas leyes de autonómicas de muerte digna que se van publicando como consecuencia de los cambios sociales experimentados por la sociedad española. Con estas leyes empiezan a admitirse toda una serie de prácticas médicas que constituyen verdaderos supuestos de eutanasia indirecta y pasiva. En una última fase, todavía por concluir, ya se ve cercano el deseado momento para muchos ciudadanos españoles en que el derecho a la eutanasia y el suicidio médicamente asistido finalmente sean legalizados en España. No obstante, todo depende del éxito en la tramitación de la proposición de ley orgánica de regulación de la eutanasia que todavía se está tramitando en las Cortes Españolas. This paper provides an analysis of the evolution of the right of people to apply and receive help to die in Spain. The first phase starts with the publication of the Penal Code of 1995, where even though this practice continues to be banned, a small loophole has been opened as the responsibility of the necessary cooperators to suicide is lessened. In the intermediate phase the Spanish legislator is gradually approaching the recognition of euthanasia through the so called laws of dignified death that are being published as a result of social changes experienced by the Spanish society. With these laws they begin to admit a whole series of medical practices that are true assumptions of indirect and passive euthanasia. The final phase, the desired moment for many Spanish citizens is already close, when the right to euthanasia and medically assisted suicide could finally be legalized in Spain. Nevertheless, everything depends on the success in the procedure of the proposal of the Organic Law of regulation of the euthanasia that is still being processed in the Spanish courts.
