Abstract

Este trabajo se centra en el análisis del artículo 510 del Código Penal situado dentro del Libro II del Código Penal, en el Título XXI denominado “Delitos contra la Constitución” y en específico, dentro del Capítulo IV de “delitos relativos al ejercicio de los derechos fundamentales y libertades públicas” de donde he extraído las características comunes y los diferentes tipos de delitos de odio que existen y qué pueden perseguirse por este artículo, así mismo he añadido jurisprudencia relativa a ello, ya que también han habido cambios en dicho artículo desde la reforma de la Ley Orgánica 1/2015, donde se han añadido nuevos tipos de acción, cambios en el sujeto pasivo, en el tipo subjetivo... El objeto es por un parte, analizar la normativa referente a estos delitos, y por otra, es que la sociedad pueda ver cuántos delitos de esta índole se producen, cuáles son las personas más vulnerables a sufrir estos delitos y cuál es la protección que tienen si llegan a ser víctimas, ya que en esa materia hay muy pocas denuncias debido a la desinformación existente. Así mismo, también se incluyen datos estadísticos para apreciar la evolución global de los delitos de odio, además de observar qué perfil suelen tener las víctimas y agresores según la edad, nacionalidad, sexo, etc.

This project is focused on the analysis of the article 510 of the penal Code, located in the second book of the penal Code, in the 21st title named "Crimes against the Constitution" and specifically, in the 4th Chapter of "crimes related to the exercise of the fundamental rights and public freedoms" from where I have taken the common characteristics and the different types of hate crimes existing and that can be chased by this article, I have also added the jurisprudence related to it because there've been also changes in this article from the Organic Law 1/2015 reform, where new types of actions have been added, there've been changes in the passive subject, in the subjective type... The object of this project, apart from analyzing the referring normative to these crimes, is that society is able to see how many crimes of this kind are done, which are the most vulnerable people to suffer these crimes and which is the protection they have if they get to be victims, because in this subject there are many few complaints due to the existing disinformation. Statistic data are included to appreciate the global evolution of the hate crimes, and also observe which profile do victims usually have according to age, nationality, genre…
