El procedimiento penal de menores

Abstract

El Código Penal establece que los menores de dieciocho años serán responsables con arreglo a lo dispuesto en la ley que regule la responsabilidad del menor, así pues es necesario crear una ley que se ajuste a les necesidades de estos seres en formación, a los cuales no se les puede exigir el mismo nivel de implicación por su falta de madurez, para asegurar su desarrollo personal. Así pues surge la Ley Orgánica 5/2000, de 12 de enero, reguladora de la Responsabilidad Penal del Menor mediante la cual se promulga el superior interés del menor como principio fundamental en todo el proceso y medida a imponer, principio que se ha ido alejado de su redacción inicial a lo largo de las distintas reformas, y que se centra en la reeducación del menor. En el presente estudio se abordarán todas aquellas cuestiones relativas al procedimiento de menores desde el momento en que comenten una infracción penal, pasando por la instrucción y el enjuiciamiento de la causa hasta el momento en que se ejecuta la medida con el objetivo de tener una visión general y esquematizada. Además, también se abordarán cuestiones relativas a los precedentes de esta ley y los principios generales que la inspiran.

The Penal Code establishes that minors under eighteen years of age will be responsible in accordance with the provisions of the law that regulates the responsibility of the minor, so it is necessary to create a law that fits at the needs of these beings in formation, to whom the same level of implication cannot be required for their lack of maturity, to guarantee their personal development. Thus comes the Organic Law 5/2000, of January 12, regulating the Criminal Liability of Minors through which the best interest of the minor is promulgated as a fundamental principle in the entire process and in the measure to be imposed, a principle that which focuses on the minor's reeducation and has been removed from its initial drafting throughout the various reforms. This study will address all issues related to the procedure of minors from the moment they commit a criminal offense, going trought the instruction and prosecution of the case until the moment that the measure will be executed, with the aim of having a vision general and outlined off this. In addition, issues related to the precedents of this law and the general principles that inspire it will also be addressed.
