Entender la delincuencia juvenil nos llevará no solo a una mejor actuación legal y social frente a ello sino también a poder crear mecanismos de prevención más eficaces. En el presente trabajo vamos a intentar dar una respuesta a este fenómeno desde un punto de vista criminológico, basándonos en las circunstancias psicológicas de los menores, concretamente menores con algún tipo de trastorno, hasta llegar a las respuestas legales. Para ello, vamos a empezar analizando cuáles son estos trastornos y su repercusión en el menor, así como los factores de riesgo y protección, qué tipo de delitos son los más comunes, y cuál es el pronóstico de futuro de los menores si no son atendidos correctamente. Todo ello respaldado por estudios científicos. Posteriormente revisaremos cuál es la respuesta penal que se da ante dichos menores dentro de España, comparándolo también con algunos de los países representativos de Europa y las normativas internacionales. Por último, vamos a intentar concretar cuáles serán los tratamientos que, junto a los organismos legales, deben centrarse en la reeducación de menores y que serán basados en tratamientos cognitivos y conductuales. Estos tratamientos no solo se centrarán en la corrección del comportamiento del menor, sino que deben tener también un carácter preventivo.

Understanding juvenile delinquency can help us not only to apply a better legal and social action against it but also to be able to create more effective prevention mechanisms. In this work we are going to try to give an answer to this phenomenon from a criminological point of view, based on the psychological circumstances of the minors, specifically minors with disorder, and then the legal answers. To do this, we will start by studying what these disorders are and their repercussion on the minor, as well as the risk and protection factors, what type of crimes are the most common, and what the future prognosis of the minors is if they are not treated correctly. All this is backed up by scientific studies. Later, we will review the criminal response to these minors in Spain, comparing it with some of the representative countries of Europe and international regulations. Finally, we will try to specify which treatments, applied together with the law, should be focused on the re-education of minors and which will be based on cognitive and behavioral treatments. These treatments will not only focus on the correction of the child's behavior but must also be of a preventive nature.
