Abstract

Para la realización de este trabajo de fin de grado se ha estudiado el procedimiento probatorio y lo que este incluye, haciendo un especial análisis de la prueba testifical, así como los derechos fundamentales de esta en el procedimiento penal. Esto se ha llevado a cabo gracias a la ayuda del trabajo realizado por diferentes autores, y al análisis de la legislación relacionada con el tema. Durante este proceso no se puede olvidar la declaración del investigado, teniendo en cuenta los distintos sitios en los que puede declarar y los derechos que le asisten. Se ha estudiado también las pruebas obtenidas con vulneración de los derechos fundamentales, así como la valoración de la prueba por el órgano judicial, en las distintas fases, en la conformidad penal y el deber del Juez o Tribunal de motivar las sentencias. Por último, se ha finalizado con los medios de impugnación y los recursos para la admisión o inadmisión de las pruebas en su valoración.

In order to carry out this end-of-degree project, the probative system and what it includes have been studied, making a special analysis of the testimonial evidence, as well as its fundamental rights in criminal procedure. This study has been possible to carry out thanks to the help of the work of different authors, and the analysis of the legislation related to the theme. During this process, the statement of the investigated cannot be forgotten, taking into account the different places where he can testify and the rights that assist him. The evidence obtained in violation of Fundamental Rights has also been studied, as well as the assessment of the evidence by the judicial organ, in the different phases, as criminal compliance and the duty of the Judge or Court to motivate the sentences. Finally, the appeal means and the resources for the admission or non-admissibility of the evidence in its assessment.
