El crecimiento de los delitos de odio en España, como sucede en el resto de la UE está aumentando, como apuntan las estadísticas del Ministerio del Interior en su último informe de 2018, la cifra ha ascendido alrededor de un 23% desde el 2014. Este aumento está muy relacionado con el discurso de odio, propagado especialmente a través de las nuevas tecnologías de la información y comunicación y el discurso político. Además genera un gran debate porque entra en conflicto con el derecho fundamental a la libertad de expresión. Por ello, definiremos las características de los delitos de odio para tener una visión general y a continuación nos adentraremos en el discurso de odio. Por último, analizaremos la respuesta penal de estas conductas incitadoras, reguladas, tras la reforma del Código Penal, en el nuevo y polémico artículo 510 del mismo.
Hate crimes in Spain is increasing, like in the rest of the UE. On the last repost from 2018 the statistics of the Ministry of Interior show that the number has increased around a 23% since 2014. This increase is related with the discourse of hate, especially spreaded by new technologies of information and communication, and political discourse. It also involves a big debate because in creates a conflict with the fundamental right of freedom speech. Therefore we will define the hate crime features to be able to have a general vision. Afterwards we will have a closer look into hate speech. Finally we will analyse the criminal response of these regulates provocative behaviours, after the Código Penal changes, in the new and controversial article 510. CP.
