El nuevo concepto de marca tras la reforma de la Ley 17/2001

Abstract

El objetivo de la armonización y homogeneización del marco normativo de la Unión Europea ha llevado al Estado Español a la aprobación del Real Decretoley 23/2018, de 21 de diciembre, de trasposición de directivas en materia de marcas, transporte ferroviario y servicios de viajes vinculados. En materia de marcas, aspecto en el que se centra la investigación de este trabajo, destaca entre todas las novedades introducidas la supresión del requisito de la susceptibilidad de la representación gráfica para el registro de un signo distintivo como marca. La eliminación de este requisito conlleva, además de facilitar la aplicación real de algunas prácticas que solo eran contempladas de forma teórica, el registro como marca de un nuevo conjunto de signos distintivos a los que el avance tecnológico ha permitido existir.
